About Toastery
Toastery (“Toastery,” “we,” “our,” or “us”) is a breakfast and brunch restaurant located in Kingston, Ontario, Canada. We operate the website toastery.ca (the “Site”) to provide information about our restaurant, menu, hours, reservations, and related services.
These Terms and Conditions (“Terms”) govern your use of the Site and any services we offer through it. By using the Site, you confirm that you are at least 18 years of age, or that you are using the Site under the supervision of a parent or legal guardian who agrees to these Terms.
Use of Our Website
You may use our Site for lawful, personal, non-commercial purposes only, in accordance with all applicable laws and regulations in Ontario and Canada.
- Browsing our menu, gallery, and restaurant information
- Making a table reservation through our booking system
- Contacting us via our contact form or listed phone and email
- Subscribing to our newsletter with your consent
- Scraping, crawling, or harvesting data from the Site without permission
- Attempting to gain unauthorised access to any part of the Site or our systems
- Transmitting viruses, malware, or any harmful code
- Using the Site to send unsolicited communications (spam)
- Impersonating Toastery, our staff, or any other person or entity
- Reproducing or commercially exploiting any Site content without our prior written consent
We reserve the right to suspend or terminate access for any user who violates these Terms, without prior notice.
Reservations & Bookings
By submitting a reservation request, you agree to the following cancellation and arrival policy:

- Confirmation: A reservation is only confirmed upon receipt of a confirmation email or message from us. Submitting a request does not guarantee availability.
- Late arrivals: Tables held beyond the grace period may be released to other guests without notice.
- No-shows: Repeated no-shows without notice may result in restriction of future reservation privileges.
- Large parties (9+): May be subject to a set menu, deposit, or advance payment, communicated at time of booking.
- Special occasions: Cake service, decorations, and special arrangements must be requested at least 48 hours in advance and are subject to availability.
- Dietary requirements: Please inform us of allergies or restrictions at the time of reservation so we can best accommodate you.
Menu, Pricing & Availability
All menu items, descriptions, and prices on our website are for informational purposes and are subject to change without notice.
- All prices are in Canadian Dollars (CAD) and inclusive of applicable taxes unless stated otherwise
- We reserve the right to modify prices, discontinue items, or introduce new items at any time
- Seasonal and daily specials are subject to availability at the time of your visit
- Menu photos are for illustrative purposes; actual presentation may vary
- Promotional pricing applies only during the stated period and cannot be combined with other offers unless explicitly stated
For the most accurate menu and pricing, we recommend visiting us in person or calling ahead.
Intellectual Property
All content on toastery.ca — including text, photographs, graphics, logos, menu designs, branding, and the overall look and feel of the Site — is the exclusive property of Toastery or its licensors, protected under Canadian and international copyright and trademark law.
- You may not reproduce, republish, or commercially exploit any Site content without our prior written consent
- Personal, non-commercial use is permitted provided you do not modify content and retain all copyright notices
- The Toastery name, logo, and tagline “From Our Toaster to Your Table” are trademarks and may not be used without written permission
- User-submitted content (photos, reviews shared via social media or email) may be used by Toastery for marketing; by submitting you grant us a non-exclusive, royalty-free licence to use it
User Conduct
When visiting Toastery in person, using our website, or interacting with us on any platform, you agree to treat our staff, other guests, and our premises with respect. We reserve the right to refuse service to any person who:
- Engages in abusive, threatening, or harassing behaviour toward staff or other guests
- Violates our in-restaurant policies (e.g., bringing outside food or alcohol)
- Provides false or misleading information in a reservation or contact form
- Acts in a manner that disrupts the experience of other guests
Toastery complies with all applicable Ontario and Canadian human rights legislation and does not discriminate on any prohibited ground including race, gender identity, disability, or religion.
Disclaimer of Warranties
Our website and content are provided on an “as is” and “as available” basis without warranties of any kind. To the fullest extent permitted by law, Toastery disclaims all warranties including:
- Implied warranties of merchantability, fitness for a particular purpose, and non-infringement
- That the Site will be uninterrupted, error-free, or free of harmful components
- That information on the Site — including menu details, hours, and pricing — is accurate or current at all times
Limitation of Liability
To the maximum extent permitted by applicable Canadian law, Toastery, its owners, employees, and affiliates shall not be liable for any direct, indirect, incidental, or consequential damages arising from:
- Your use of or inability to use the Site or its content
- Errors or omissions in the Site’s content
- Unauthorised access to your data or transmissions
- Any third-party content, products, or services linked from our Site
- Any matter beyond our reasonable control
Allergen & Dietary Information
Toastery takes food allergies and dietary requirements seriously. Please be aware of the following:
- Our kitchen handles common allergens including gluten, dairy, eggs, nuts (tree nuts and peanuts), sesame, soy, and shellfish
- We cannot guarantee a completely allergen-free environment due to the risk of cross-contamination
- Menu descriptions may not list every ingredient; guests with severe allergies must inform their server before ordering
- Allergen information on our website is provided in good faith and may change based on supplier or recipe variations
- Toastery shall not be held liable for adverse reactions arising from undisclosed dietary requirements
Third-Party Services & Links
Our Site may link to or integrate third-party services such as reservation platforms, mapping, social media, and payment processors. These are provided for convenience only.
- We do not control, endorse, or take responsibility for any third-party website or service
- Your use of third-party services is governed solely by their own terms and conditions

Gift Cards & Promotions
- Redeemable at Toastery Kingston only and have no cash value
- Lost, stolen, or damaged gift cards cannot be replaced
- Gift cards do not expire and are subject to applicable Ontario gift card legislation
- Cannot be used to purchase other gift cards
- Valid only during the stated period and while availability lasts
- One promotion per person or table unless otherwise stated
- Cannot be combined with other offers, discounts, or gift cards unless explicitly stated
- Toastery reserves the right to cancel or modify any promotion at any time without notice
- Promotional codes are single-use and non-transferable unless stated otherwise
Governing Law & Disputes
These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict of law principles.
Any dispute arising from these Terms shall first be attempted to be resolved informally by contacting us at info@toastery.ca. We will make good-faith efforts to resolve the matter within 30 days.
If informal resolution is not possible, any legal proceedings shall be brought exclusively in the courts of competent jurisdiction in Kingston, Ontario, Canada.
Changes to These Terms
We reserve the right to update or modify these Terms at any time. When we do, we will revise the “Last Updated” date at the top of this page. Continued use of the Site after any changes constitutes your acceptance of the updated Terms.
For material changes, we may provide additional notice via a prominent banner on the Site or by email to newsletter subscribers. We encourage you to review these Terms periodically.
